The High Court in Kumasi has adjourned proceedings in the widowhood dispute of late highlife legend Charles Kwadwo Fosu, popularly known as Daddy Lumba, to Tuesday, November 18, 2025.
The case centers on who should be recognised as the legal wife to perform the widowhood rites.
On Monday, November 17, cross-examination began for the plaintiff, Akosua Serwaa’s legal representative, Georgina Osei, based on her witness statement. During questioning, the defence suggested that a head drink had been returned by Akosua Serwaa to Daddy Lumba, signalling the end of their marriage, but the witness denied this.
Osei was also shown a video purportedly showing Daddy Lumba confirming who performed in-law rites at his mother’s funeral. She maintained that the footage had been edited. When asked whether the plaintiff’s refusal to perform the in-law rites (nsiyie) caused their separation, she again referenced the video, insisting it had been tampered with.
The witness further denied claims that the deceased failed to attend the funeral of the plaintiff’s mother on January 4, 2018. On the question of whether the family of a deceased person bears responsibility for burial and final funeral rites, she confirmed it does.
The plaintiff’s marriage certificate with the deceased also surfaced, with defence lawyers questioning its authenticity. They noted that the certificate lists her birth name as Akosua Serwaa Schindler, contradicting the witness’s statement that her birth name is simply Akosua Serwaa.
Cross-examination is set to continue on Tuesday, November 18. Defence counsel Dominic Kwadwo Osei expressed satisfaction with the proceedings so far, emphasizing that the final decision rests with the judge.
“The judge has promised to give us the final judgment on the 25th of November. The case is progressing as we expected, but the final decision rests with the judge. Besides, the plaintiff has yet to present their case, so at this point, we cannot determine our fate,” Osei said. “Our focus is not just on victory or defeat; we are here to ensure justice prevails and that peace is maintained for the funeral to be held smoothly.”
Daddy Lumba passed away on July 26, 2025, and a dispute has since emerged over whether Akosua Serwaa, who claims to be the lawful wife, or Priscilla Ofori (Odo Broni) is legally entitled to perform the widowhood rites.
