Daddy Lumba Estate Dispute Escalates as Akosua Serwaah Appeals High Court Ruling

Akosua Serwaah has taken her legal battle over the estate of late highlife legend Charles Kwadwo Fosu, popularly known as Daddy Lumba, to the Court of Appeal in Kumasi.
She is challenging a High Court ruling that recognized both her and Priscilla Ofori, also known as Odo Broni, as the lawful surviving spouses of the musician.
In her notice of appeal, Ms. Serwaah contends that the Kumasi High Court erred in rejecting a marriage certificate she presented to support her claim. She argues that the trial court wrongly deemed the certificate inadmissible and misapplied the Evidence Act, 1975 (NRCD 323), in assessing its validity.
The appellant is seeking a Court of Appeal ruling to overturn the High Court’s decision and declare her the sole lawful surviving spouse of Daddy Lumba.
High Court Ruling
On November 28, 2025, Justice Dr. Dorinda Smith Arthur of the Kumasi High Court dismissed Ms. Serwaah’s suit, which sought to establish her as the only surviving spouse. The court found that she had not proven that her marriage to the late musician under the Marriage Ordinance would make her the sole surviving spouse.
Evidence presented indicated that Daddy Lumba’s marriage to Akosua Serwaah was conducted under customary law, which allows for polygamy. Consequently, the court held that his subsequent marriage to Odo Broni was legally valid under Ghanaian law.
The High Court therefore recognized both Akosua Serwaah and Priscilla Ofori (Odo Broni) as legally recognized surviving spouses of the late music icon.
