Frank Davies, legal counsel for former Finance Minister Ken Ofori-Atta, has urged the Office of the Special Prosecutor (OSP) to prioritize formally charging his client rather than engaging in public criticism.

He emphasized that Ofori-Atta, who remains uncharged, retains the rights of any Ghanaian citizen, including the freedom to travel for medical reasons.

The call comes amid widespread public debate over Ofori-Atta’s recent trip abroad and scrutiny of the OSP’s handling of investigations into his tenure at the Finance Ministry. Critics have questioned why the former minister was able to leave the country despite ongoing inquiries.

In a prior interview on the KSM Show, Special Prosecutor Kissi Agyebeng explained that his office’s limited authority over Ghana’s exit points, including Kotoka International Airport, and insufficient cooperation from state security agencies at the time constrained efforts to prevent Ofori-Atta’s travel. He also hinted that the former minister’s close association with ex-President Nana Addo Dankwa Akufo-Addo complicated enforcement.

Addressing the matter on Wednesday, November 5, Mr. Davies stated, “We all heard him last week that he said he was going to arraign charges. He was going to charge Ofori-Atta before the end of this month. I think he should concentrate on that and charge him. But for now, Ken Ofori-Atta has not been charged with any offence. He is just like any other ordinary Ghanaian, and if he has to travel for medical reasons, he will travel.”
