Duffuor Case: 60% Asset Recovery No Justification to Drop Charges – Tuah-Yeboah

Former Deputy Attorney General Alfred Tuah-Yeboah has strongly criticised the current Attorney General, Dr. Dominic Ayine, for entering a nolle prosequi—a formal notice to discontinue prosecution—in the ongoing case involving Dr. Kwabena Duffuor and seven others.

Dr. Ayine justified the decision by citing significant progress in asset recovery, with 60% of the alleged funds reportedly recovered, as well as the legal complexities surrounding the case.

Tuah-Yeboah dismissed the explanation as inadequate, arguing that partial recovery should not replace the need for full accountability through legal proceedings.

“The moment you give that explanation, people will naturally begin to question it,” Tuah-Yeboah said. “If he had simply entered a nolle prosequi without explanation, there would have been less speculation. But now he’s suggesting that 60% recovery is sufficient—on that, I must disagree.”

He added that recovering 60% of the alleged amount—approximately GHS3.6 billion out of the GHS5.7 billion involved—still leaves a significant shortfall.

“Who accounts for the remaining 40%? Especially when there are allegations that GHS2.1 billion was falsified. That opens another question: Who falsified it? The receiver was appointed by the Bank of Ghana. There must be more clarity,” he stated.
