No Basis to Remove EC Chair and Deputies — Chief Justice Informs Mahama

The Chief Justice, Paul Baffoe-Bonnie, has ruled that there is no prima facie case to warrant further investigations into petitions seeking the removal of the Jean Mensa, her deputies, or the Kissi Agyebeng.

According to a statement from the Presidency on Wednesday, February 18, 2026, President John Dramani Mahama referred seven petitions requesting the removal of the Electoral Commission Chairperson and her deputies, along with three petitions concerning the Special Prosecutor, to the Chief Justice for determination.

The referral was made under Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959), to ascertain whether the petitions disclosed a prima facie case.

The petitions were originally referred to the Chief Justice on November 25, 2025. By a letter dated January 26, 2026, Chief Justice Baffoe-Bonnie informed the President that the petitions did not establish a prima facie case to justify further investigation or removal proceedings against the officeholders.

The statement, signed by Felix Kwakye Ofosu, Spokesperson to the President and Minister for Government Communications, confirmed that the development effectively brings closure, at this stage, to the petitions seeking the removal of the affected officials.
