Ablekuma North: NPP Candidate Sues EC Over Planned Rerun in 19 Polling Stations

The New Patriotic Party (NPP) parliamentary candidate for Ablekuma North, Nana Akua Owusu Afriyie, has dragged the Electoral Commission (EC) to court in a bid to stop the planned rerun of parliamentary elections in 19 polling stations within the constituency.
This legal action follows the EC’s announcement on 2 July 2025, indicating its intention to rerun elections at the affected polling stations on Friday, 11 July 2025. The EC says the move is aimed at resolving a months-long electoral stalemate stemming from the 2024 general elections.
However, the NPP has rejected the rerun as procedurally flawed and unlawful.
In a suit filed at the Accra High Court on Monday, 7 July 2025, Nana Akua Owusu Afriyie, represented by her lawyer Gary Nimako, described the EC’s decision as “arbitrary and unreasonable,” arguing that it infringes on her constitutional rights and disregards a standing court order.
The case references a High Court ruling dated 4 January 2025, which directed the EC to complete the collation of results, noting that only three polling stations remained outstanding—not 19. The plaintiff contends that the EC’s latest directive contradicts that ruling.
The suit is seeking the following key reliefs:

A declaration that the EC’s decision to rerun elections in 19 out of 281 polling stations violates the High Court’s 4 January 2025 order.

An order of certiorari to quash the EC’s decision outlined in a 1 July letter and a 2 July press release.

An injunction to restrain the EC from holding any rerun in the constituency regarding the December 2024 parliamentary election.
